RECAST OF THE REGULATION ON PREVENTING AND REDUCING THE EFFECTS OF MAJOR INDUSTRIAL ACCIDENTS IS PUBLISHED!

The Regulation on Preventing and Reducing the Effects of Major Industrial Accidents No:30702 published on the date March 2, 2019 by the cooperation of Ministry of Family, Labour and Social Services (MoFLSS), the Ministry of Environment and Urbanization (MoEU) and the Ministry of Interior. Regulation no 28867 dated 30 December 2013 has been repealed. 

The purpose of this Regulation is; that prevention of major industrial accidents, reduction of harmful effects resulting from industrial accidents on human health and on the environment to the lowest possible levels, determination of all measures to provide effective and continuous protection and risk management within establishments containing hazardous substances/mixtures.

Some important points in the regulation are as below:

The general obligation of the operator;

The operator compiles a sheet (Dangerous Goods Response Sheet) in accordance with the format in Annex-7, which contains the protective equipment information for each hazardous substance included in the scenarios in the major accident scenario document, in case of a major industrial accident.

The operator is obliged to submit this sheet; to the regional administrations, provincial health directorate, to the disaster and emergency directorate, to the relevant fire department (depending on their location). 

The obligation to compile a Dangerous Goods Response Sheet becomes mandatory as of 1 July 2020.

Dangerous Goods Response Sheet shall be compiled based on the Safety Data Sheets stored at the site and include hazard statements in accordance with the Turkish SEA regulation 28848 which is the implementation of the EU CLP (EC) No. 1272/2008 on Classification, Labelling and Packaging of Substances and Mixture. In this context, it is critical that the SDS’s are compiled in accordance with the SDS regulation 29204 and SEA regulation 28848 by the certified SDS experts as required by the regulation which has the required experience and expertise. 

In case of SDSs compiled with false or inadequate information, your efforts to comply with Regulation on Preventing and Reducing The Effects of Major Industrial Accidents will also be incomplete and inaccurate.
